GENERAL
These conditions of sale are concluded between, on the one hand, Atelier Berenson and, on the other hand, any natural or legal person wishing to make a purchase via the site www.atelierberenson.com referred to as “the customer”.

These conditions of sale alone will govern all sales contracts between Atelier Berenson and its customers, acceptance of any offer from the site implies adherence to it. The conditions of sale, prices, information and photos shown on these sites do not bind Atelier Berenson, which reserves the right to modify them without notice, it being understood, however, that the data on the day of the order are the only applicable to the customer.

PRICES
Prices are in euros including tax.
Prices do not include postage and packaging, these are calculated and specified to the customer after calculation when ordering and are based on the weight of the items and the country.

ORDER ACCEPTANCE

Each order is accepted if the customer:
- completes the identification form on which he indicates all the requested details;
- validates his or her order after having checked it;
- makes the payment under the conditions provided.
All the data provided and the recorded validation will constitute proof of the transaction.

DELIVERY
Notwithstanding any clause to the contrary, our goods travel in all circumstances at the risk and peril of the customer. Consequently, the customer must check the deliveries and exercise, if necessary, the necessary remedies in terms and within the time limits provided for by law. The complaint must be made first to the agent in charge of distributing the package, then to our company.

Despite all the care taken by our company in stock supply, an item may become unavailable between order taking and delivery. If it is impossible to honor all or part of the order, the customer's account is credited by Atelier Berenson for the amount of the undelivered items. Atelier Berenson then notifies the customer by email.

Orders are processed after receipt of full payment of the invoice. Delivery times vary depending on the type of order and manufacturing times. Atelier Berenson undertakes to contact the customer to inform him of the production times. The delivery time in fine is that of the carrier. It is on average two (2) days in metropolitan France. Unless otherwise stipulated when ordering, any delivery made beyond a period of sixty (60) days through the fault of Atelier Berenson may give rise to the cancellation of the order by the customer and a refund.

Withdrawal / return of the product
The customer has the option, in accordance with article L 121-16 of the Consumer Code, of returning the product in its original condition, at its own expense (in its original packaging), within seven (7) days. from its delivery for exchange or refund without penalty. On the other hand, Atelier Berenson cannot be held responsible for damage to the product related to transport. No refund will be made in the event of breakage, breakage or degradation of the returned item.

TITLE RETENTION CLAUSE
The goods sold by Atelier Berenson remain its property until full and effective payment by the customer.
In the event of repackaging, transformation or personalization of the goods delivered for resale, the customer must obtain our prior authorization, in contractual form, after presentation of the product obtained.

INTELLECTUAL PROPERTY
All elements concerning the www.atelierberenson.com site are and remain its exclusive intellectual property. Any reproduction, exploitation, redistribution or use of the elements of these sites, whether textual, software, visual or sound, is strictly prohibited under penalty of criminal prosecution. Any simple or hypertext link on these sites is strictly prohibited without the express written consent of our company.

IT and freedom

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, the customer has the right to access and rectify information concerning him.

APPLICABLE LAW AND DISPUTE RESOLUTION
These online sales conditions are subject exclusively to French law. In the event of a dispute, exclusive jurisdiction is assigned to the French courts, notwithstanding plurality of defendants or warranty claim.
